On May 7, 1974, Frank Edward Teesateskie was convicted by a jury of violating 18 U.S.C. ? 1163 by embezzling money which was in his possession and care as an employee of Qualla Housing Authority, but which belonged to that Indian tribal organization. On direct appeal, Teesateskie urges reversal of his conviction on the ground that the evidence presented by the government was insufficient to show that: (1) the shortages alleged were actually as great as alleged; (2) defendant was responsible for the shortage; (3) defendant had any intent to take money in his custody; and (4) defendant applied money in his custody for his own use. After reviewing the record, the brief for Teesateskie as appellant, and the brief of the government as appellee, we conclude that the appeal is without merit and must be dismissed.
